Failing property performance, cessation of distributions, excessive fees, and suspicions of mismanaging funds are among the reasons that owners seek out new management firms. Owners often face serious challenges in removing incumbent managers, however, including: roadblocks in obtaining contact information for other owners, contract language that often makes it very difficult to terminate agreements, gaining lender approvals for successor managers, etc. These issues are further complicated when the manager holds a small ownership interest which they can use to block the hiring of a successor manager.
